TERMS & CONDITIONS  and any other agreement(s) if any, on the basis of which we provide you Services, shall be governed by and construed in accordance with prevalent laws  of India.

www.slgsuriyatea.com is a website (the “Website”) and is run/operated by Slg Suriya Developers LLP (a Limited Liability Partnership firm, LLIPN No: ACH-2727, Office at : 242 Netaji Subash Road, “Maa Durga Bhawan”, Subashpally, P.O. Siliguri – 734001, Dist: Darjeeling, West Bengal) and is the “Website Owner”. Here in after “we” or “us” or “our” provides the information contained on this Website or any of the pages comprising the Website to visitor(s) referred to as “you” or “your” or “users” , are subject to the terms and conditions and  the privacy policy set out in this Website and any other relevant guidelines, policies/notices which may be applicable to a specific section or module of this website. Hence please read the TERMS & CONDITIONS , privavy policy/ guidelines/agreement(s) carefully. As such,  browsing/ accessing or using the website or by using any facilities/ services made available through it or by transacting through or on it, you do  agree to the terms and conditions that are appended below (all of which are called the “Agreement”). Hence, this Agreement is made in between you and us.

Availability of Website :

Slg Suriya Developers LLP may suspend the Website for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades, and shall not be liable to you for any such suspension /maintenance work or process.

We reserve the right to make any change(s) to the Website or to discontinue any aspect or feature of the Website without with or without any prior notice.

In the event at our sole  discretion, consider that you are making any illegal and/or unauthorised use of the Website, and/or your use of the Website  breaches any of the Terms/conditions, we reserve the right to take any action that is deemed necessary, including terminating/blocking your account with /without any notice. Also, legal proceedings may be initiated if necessary.

User’s/Customer’s Status

By placing an order to purchase any of our Products (Order) through the Website, you declare that: (a) You are legally capable of entering into binding contracts; and (b) that you are not below 18 years of age.

OUR DELIVERY POLICY :

Once you place an order, you will receive an email from us that we have  received your order. This does not mean that your Order has been accepted. Your Order constitutes an offer to us to buy a Product from our  Organization that offers the Product for sale via our Website. The orders are subject to acceptance by us/Website, and such acceptance shall be confirmed to you through an email Such contract between us/website and you will only be informed when you get our Dispatch Confirmation through email.

1. Every order/Contract relates only to those Products whose dispatch the website has confirmed in the Dispatch Confirmation. We  shall not be obliged to supply any other Products which may have been part of your Order until the dispatch of such Products has been confirmed by way of a Dispatch Confirmation by us.
2. It is to be noted that your contract with us relates only to your use of the Website and the Services available therein.
3. We try to ship all retail orders received before 12 p.m. IST by the next working day. However, under exceptional circumstances it can take upto 1-3 working days for order processing.
4. Our aim is to dispatch the ordered products within 24 hours of payment clearance and to have all orders delivered to customers residing in India within 5-7 working days. You may get notification for delay from our end in case a product is out of stock.
5. Presently, we do not ship our products outside India.

Credit Card Payment

Whenever you do transaction through credit card , please see that it is your own credit card. We cannot/shall not take any liability for any credit card fraud. All such liability(s)  to use a card fraudulently, shall exclusively  be on the you/user along with the onus to ‘prove otherwise’.

USE OF THE CONTENT/TRADEMARKS etc.

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under licence, by the business and / or its associate entities who feature on this Website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.

You are hereby restricted not sell or modify any of the content of this Website or reproduce, display, or publicly perform, distribute, or otherwise use any of the materials in any way for any public or commercial purpose without any written/prior permission of the Owner 

Other/outside Links

If ever we provide any external link for your convenience, it is to be noted that they are beyond the control of the Website Owner and no representation is made as to their content. Relying/using  any external links and the content thereon provided, shall be  at your own risk.

OUR RETURNS/REPLACEMENT POLICY :

Tea is a  perishable item, hence we do not normally accept returns of our products. However, if there is a mistake form our end, we accept returns and shall refund under the following circumstances/ conditions:

1. If the delivered item/packet/pouch is a different item than what you had ordered, please contact us via phone or email, as you are eligible to get the product returned/ replaced or get your money returned. The item/packet/pouch  must be unopened & unused and returned along with its original-form.
2. Also, if you are delivered a damaged item. please contact us via phone or email, as you are eligible to get the product returned/ replaced or get your money returned.
3. In case of returns due to damaged/defective product, we will issue you a full refund including the delivery charges incurred by you for receiving and sending back the product. We can also replace the product at no extra cost, if you wish.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

We, in no event, or any parties/organizations/ entities/persons/ officers/our staffs associated with the our FIRM/brand-name  or otherwise, mentioned at this Website shall ever be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost or profits, or damage caused/done to computer hardware or loss of data information or business interruption) resulting from the use or inability to properly use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory/term(s) and whether or not, such organization or entities were advised of the possibility of such damages earlier.

Restriction of use of  Website outside India

We do not/cannot make any warranty or representation that information on the website is appropriate for use in any other jurisdiction (outside INDIA).

No Commercial Use

This Website is for your personal, use only and to be used for the services we provide herein. You are restricted not to modify, copy, distribute, transmit/display/perform/ reproduce/ license’/ publish,/ exploit commercially, create derivative works from, transfer any contents herein.  Also, you are hereby restricted to sell any content/ software/ products, , or services contained within our website. Registering/opening of User account :

Users/buyers/Visitors shall register with the Website in order to use some of the services/features/benefits made available on this Website. While registering/opening of your User account, you are required to provide information about yourself which are true, accurate, current and complete in all respects. CHANGES/VARIATIONS IN THE TERMS AND CONDITIONS :

We reserve the right to change and amend the above terms and conditions, if ever and whenever required, due to changes in our policies and capabilities or due to any change in laws and regulations or as may be required by any of Government Authority.

As user/ customer, you will be subject to the terms and conditions presently in force at the time  you order any products from us.

As and when necessary, we may at any time modify any relevant terms/ conditions/ policies / notices etc at our discretion/ or due to demand of circumstances, may be generally or may be legal obligation.

VARIATIONS IN PRODUCT

We aspire to provide you with the best-consistent-product. and consistent quality of product. But, there is natural variations in the quality of tea due to its seasonal nature. Hence, there may be  some natural variations in the taste and quality of the same product at different season of a year.

SHELF LIFE & STORAGE CONDITIONS

All the tea we sell has a shelf life of 24 months. Still, we write 12 months for best result and it is obligatory too, legally.

The use of this Website/Portal:

Buyers/Customers agree, undertake and confirm that Buyers/Users’ use of  the Website/Portal/ shall  strictly  be governed by the following binding principles:

1. That users/ buyers/ customers release and indemnify us and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Website/Portal/and specifically waive any claims that Buyers may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, we cannot take responsibility or control the information provided by other Users which is made available on the Website/Portal. Buyers/users may find other User's information to be offensive, harmful, inconsistent, inaccurate, or deceptive. Please use caution and practise safe/ fair trading when using the Website/ Portal.
2. That the  Buyers/users  shall not use any "deep-link", "page-scrape", "robot", "spider" or any other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website/Portal or any Content, or shall not in any way reproduce or circumvent the navigational structure or presentation of the Website/Portal or any Content, to obtain/ attempt to obtain any materials/ documents/ information through any means not purposely made available through the Website/Portal. To be noted that we reserve our right to bar any such activity.

That the buyers/ customers shall refrain from use of material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information and anything of the kind;
4. That the buyers/ customers shall refrain from use of material that threatens the unity, integrity, defence, security or sovereignty of India in what so ever way, friendly relations with foreign states, or public order or causes to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
5. That the buyers/ customers shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any green tea leaf, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law/ concerned Department, rule, regulation or guideline for the time being in force.
6. That the buyers/ customers shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or Users/Buyers/Sellers etc;
7. That the  Buyers/Users shall not probe, scan or test the vulnerability of the Website/Portal or any network connected to the Website/Portal nor breach any/ the security or authentication measures on the Website/Portal or any network connected to the Website/Portal and should not reverse look-up, trace or seek to trace any information on any other User of or visitor to Website/Portal, or any other customer, including any account on the Website/Portal not owned by Buyers/Users, to its source, or exploit the Website/Portal or any service or information made available or offered by/ through the Website/Portal, in any way, where the purpose is to reveal any information, including but not limited to personal identification or information, other than Buyers/ Users’ own information, as provided by them for by the Website/Portal.                                                                
8. That the Buyers/Users shall not make any negative/ defamatory statement(s)  or comment(s) about Us or the brand name or domain name used by Us including any  terms or otherwise in any way, engage in any conduct or action that might tarnish the image or reputation, of us. or Buyers/Users on platform or otherwise tarnish or dilute any  of our trade or service/ service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. Also the  Buyers/Usersd agree that they will not take any action that impose an unreasonable or disproportionately large load on the infrastructure of the Website/Portal or our systems or networks, or any systems or networks connected to the website, in any way.
9. That the Buyers/users shall not attempt in  gaining unauthorized access to any portion or  feature of the Website/Portal, or any other systems or networks connected to the Website/Portal or to any server/ computer/ network, or to any of the services offered on or through the Website/Portal, by hacking, password "mining" or any other illegitimate means/or means of illegitimate Activities.

That the Buyers/ Users hereby agree not to use any device/ software or routine to interfere  or attempt to interfere in any way with the proper working of the Website/Portal or any transaction, if any, being conducted on the Website/Portal, or with any other person's use of the Application/Website/Portal.
12. That the Buyers/ Sellers/Users should not forge headers or otherwise manipulate  identifiers in order to disguise the origin of any message or transmittal Buyers/ Users send to Us on or through the Website/Portal or any service offered on or through the  Website/Portal. Buyers/ Users may not pretend that Buyers/ Users are, or that Buyers/  users represent, someone else, or impersonate any other individual or entity etc.
13. That the  Buyers/ Users may not/ should not use the Website/Portal or any content for any purpose that is unlawful or prohibited by these Terms & Conditions, or to solicit the performance of any illegal activity/activities or other activity which infringes or may infringe the rights of us/the website and / or others.
14. That the Buyers/ Users shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as may be amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to GST, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies etc.) regarding Buyers/ Users’ use of Our service and Buyers/users listing, purchase, solicitation of offers to purchase or services.

Applicable/Jurisdiction

All the  relevant terms and conditions/privicy policies/notices shall be governed by and construed in accordance with the laws of India without giving effect to any principles of conflict of law. Thus you do hereby give your  consent  to the exclusive jurisdiction of the courts in the District of Darjeeling/Jalpaiguri, in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related in/with the website.

Governing Law and Jurisdiction: 

It is to be noted that his User Agreement(s) shall be construed in accordance with the applicable laws of India and that the  Courts at Siliguri / jalpaiguri shall have exclusive jurisdiction in any proceedings arising out of this agreement, be it a dispute/ difference, either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, and that the same shall be referred to an independent arbitrator who will be appointed by us and his decision shall be final and binding on the parties hereto.
